Why is Kane County Restricting First Amendment Rights?

Geneva, IL – On Monday, August 26, 2024, citizens exercising their First Amendment rights by distributing flyers to people entering the Kane County Government Building were abruptly asked to cease their activities. This request followed closely after Kane County Board Chairperson Corinne Pierog picked up one of the flyers, which graded her performance record for voters. Within 24 hours, the County established a so-called “First Amendment Zone,” located far from the building entrance, where citizens would be allowed to hand out materials or engage in conversations.

“How can free speech and First Amendment rights be restricted to a designated area? This is unconstitutional,” said Andro Lerario, Chairperson of the Kane County Republican Central Committee. “This is a blatant attempt by Chair Pierog to limit free speech, something she has been trying to do for months.”

Throughout 2024, Chairperson Pierog has consistently shown disregard for public input. She has frequently interrupted speakers, advocated for reducing public speaking time limits, and strategically buried public comments within the meeting agenda to minimize participation. “She doesn’t like listening to the voters of Kane County, and this latest move is just another example of her efforts to stifle free speech,” added Lerario.

In response to the establishment of the “First Amendment Zone,” concerned citizens contacted Kane County State’s Attorney Jamie Mosser. However, no action has yet been taken to restore free speech rights or remove the unconstitutional restrictions. Andrew Sosnowski, candidate for Kane County State’s Attorney, expressed his dismay at the situation. “In Kane County and across the United States, people’s rights should never be infringed upon. Just because you don’t agree with someone’s point of view doesn’t give you the right to restrict free speech. Government officials who abuse their power for personal gain must be held accountable.”

Linda Prestia, spokesperson for Sosnowski, emphasized the need for change. “This is why Kane County needs a new State’s Attorney who understands that our freedom of speech is paramount and must not be impeded by elected or unelected officials. Andrew Sosnowski will be the protector of everyone’s right to free speech and the right to assemble and share their grievances with our government.”
